Terms & Conditions of Use

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of TFI's website, platforms, and services. By accessing or using TFI services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

TFI operates in compliance with the Protection of Personal Information Act (POPIA), the Promotion of Access to Information Act (PAIA), and applicable international data protection principles (GDPR-aligned).

2. Definitions

• "TFI": the company providing digital, AI, telecom, and technology services
• "User": any individual or entity accessing TFI services
• "Services": all offerings including digital platforms, AI solutions, telecom services, integrations, and support
• "Personal Information": as defined under POPIA

3. Use of Services

Users agree to use services lawfully and responsibly, provide accurate and truthful information, and not misuse, disrupt, or attempt unauthorised access.

Users must not engage in fraudulent, abusive, or unlawful activity; interfere with system integrity or security; or reverse engineer or exploit TFI technologies.

4. Intellectual Property

All content, systems, platforms, and materials are owned by TFI or licensed to TFI, including software and platforms, AI models and outputs, and designs, branding, and content.

Users may not copy, reproduce, or distribute content without consent; modify or create derivative works; or use TFI intellectual property for commercial purposes without authorisation.

5. Service Availability

TFI does not guarantee uninterrupted or error-free services and may modify, suspend, or discontinue services at any time. Planned maintenance and updates may impact availability.

6. User Accounts (If Applicable)

Users are responsible for maintaining the confidentiality of login credentials and for all activities under their account. TFI reserves the right to suspend or terminate accounts for misuse.

7. Fees and Payments

Where applicable, fees will be defined in separate agreements or proposals, and payment terms must be adhered to. Failure to pay may result in suspension of services, termination of agreements, and legal action and financial penalties.

8. Data Protection & Privacy

TFI processes personal data in accordance with its Privacy Notice and the Protection of Personal Information Act (POPIA). By using TFI services, users consent to data collection and processing and the use of cookies and tracking technologies.

9. AI and Automated Services

Where AI is used, outputs may be probabilistic and not always accurate, and human oversight may still be required. Users acknowledge that AI outputs should not be solely relied upon for critical decisions, and responsibility for final decisions remains with the user.

10. Third-Party Services

TFI may integrate with third-party platforms. TFI is not responsible for third-party systems or services, or their availability, security, or data practices. Users are subject to third-party terms where applicable.

11. Limitation of Liability

To the maximum extent permitted by law, TFI shall not be liable for indirect, incidental, or consequential damages; loss of profits, data, or business opportunities; or service interruptions or system failures. Total liability (if applicable) is limited to fees paid by the user for services (where applicable).

12. Indemnity

Users agree to indemnify TFI against claims arising from misuse of services, breach of these Terms, and violation of laws or third-party rights.

13. Termination

TFI may suspend or terminate access if Terms are breached or illegal or harmful activity is detected. Upon termination, access to services will cease and data handling will follow the Privacy Notice and DPA.

14. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes will be subject to South African jurisdiction.

15. Changes to Terms

TFI may update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
